For users of literary works

LATGA is the only collective administration organisation in Lithuania representing authors and translators of literary works. We collectively administer the right to reproduce literary works in the form of an audio or audiovisual recording and to perform them publicly at events, as well as collecting remuneration for the public communication of works on radio and television, and compensation for the reproduction of works by means of reprography from companies selling reprographic devices and providing reprographic services.

Use of literary works in advertising

We do not license the use of literary works in advertising and other works. If you intend to use the works in advertisements for goods and services (both audio and video) or in other works (for example, a film), you must obtain the express permission of the author or his/her successors.

 

Term of validity of copyright

If the author of the work died 70 years ago or more, the author’s economic rights are no longer valid. You are free to use this work, as long as you do not infringe the author’s personal moral rights (attribution and use the work as it was created by the author, without any modification).

Publication on the internet

To make literary works the copyright of which is still in force publicly available online, you must obtain permission directly from the author, his/her successors or other rights holders, if the author has transferred his/her rights to other persons (e.g. a publishing house). Permission from rights holders is also required to rent or lend books, except for use in libraries, for which the state pays a compensation fee, which we distribute to authors once a year.

Exceptions

Section 4 of the Law on Copyright and Related Rights provides for cases in which works may be used without the author’s permission (for personal, educational, information purposes). However, please respect copyright and use only legal sources.

On 7 December 2016, the Government of the Republic of Lithuania adopted Resolution No. 1227 “On the Description of the Procedure for the Collection, Distribution, Payment and Return of Compensation for the Reproduction of Works for Private Purposes by Means of Reprography”. According to this description, the compensation for the private reproduction of works by reprography must be paid by undertakings (operators) providing paid copying services. Operators have to submit a notification form once a year (by 15 January) on the copying services they provide. The compensation payable is calculated and invoiced on the basis of the declaration submitted.

Importers of multifunctional copiers, printers and scanners, i.e. companies selling this equipment for the first time in the territory of the Republic of Lithuania, are also liable to pay the compensation fee. These companies report sales on a quarterly basis.

Companies and institutions are entitled to recover the compensation paid when the equipment is purchased for professional use, for the needs of disabled people or when it is taken out of the territory of the Republic of Lithuania.

If you are a radio or TV broadcaster and you use works by Lithuanian and foreign literary authors represented by our organisation in your broadcasts, you need to enter into a licensing agreement so that we can collect and pay royalties to the authors for the use of their works. The author’s right to receive remuneration for each use of his work is provided for in the Republic of Lithuania Law on Copyright and Related Rights. If you already have a contract for the use of musical works, you do not need to conclude another contract.

The amount of royalties payable is expressed as a percentage of the broadcaster’s revenue. See below for full details of the applicable rates. For more information or to enter into a licensing agreement, please contact the contacts below.

If you are a rebroadcaster of broadcast TV programmes, you also need to enter into a licensing agreement so that we can collect and pay royalties to authors for the use of their works.

The royalty rate to be paid is determined through negotiations with the associations of cable retransmission operators.

If you are organising an event and you will be using literary works by Lithuanian or foreign authors represented by our organisation, you will need to enter into a licensing agreement so that we can collect and pay royalties to the authors for the use of their works. The author’s right to receive remuneration for each use of his work is provided for in the Republic of Lithuania Law on Copyright and Related Rights. You must apply for a licence agreement at least 14 business days before the start of the use of the works.

The amount of the fee is based on the number of spectators (if the event is free of charge), the income from ticket sales (if the event is chargeable), the area of the event hall, the number of days of the event (in the case of fairs, exhibitions).

If you are releasing a CD, DVD, vinyl record (or other) that will use works by Lithuanian literary authors represented by us, you need to enter into a licence agreement so that we can collect and pay the authors royalties for the use of their works. The author’s right to receive remuneration for each use of his work is provided for in the Republic of Lithuania Law on Copyright and Related Rights.

The amount of the contribution is calculated on the basis of the number of print runs and copies and the wholesale/retail selling price.

Who pays compensation for reproduction by reprography?

Companies and institutions providing paid copying services and sellers of reprographic devices (multifunction copiers, printers, scanners) who are the first sellers of these devices in Lithuania must pay the compensation fee for the reproduction of works by reprographic means for private purposes.

What is the deadline for reporting sales of reprographic devices and copying services?

Operators providing paid copying services must submit declarations by January 15 each year. Sellers of reprographic equipment must report sales either quarterly or monthly.

What are multifunction copiers?

Multifunction copiers are devices capable of copying, printing, and scanning artwork.

What is the difference between multifunction copiers and copiers and printers?

A multifunction copier includes all the functions for reprographic reproduction of a work, such as copying, printing, and scanning. A photocopier copies from paper to paper, while a printer is a computer device that prints information from the computer onto paper.

In what cases can I recover the compensation paid?

In addition to individuals who have purchased reprographic devices for professional use or those with disabilities, companies that export these devices from Lithuania can also recover compensation.
